About Strike Offenses in Ventura County

California’s Three Strikes law (Penal Code Section 667 and Section 1170.12) doubles the sentence on a new felony where the defendant has one prior serious or violent felony conviction, and imposes a minimum 25-years-to-life sentence with two or more prior strikes (though after Prop 36 in 2012, the third strike must generally be a serious or violent felony to trigger the indeterminate life term). Serious felonies are listed at Section 1192.7(c) and violent felonies at Section 667.5(c). Strikes include first-degree burglary, robbery, most sex offenses, felony assault causing great bodily injury, and offenses committed with a firearm.

In Ventura County, the DA’s office generally pleads strike allegations when supported by the record, but courts have discretion under People v. Romero to dismiss a strike allegation “in furtherance of justice” (a Romero motion). A well-supported Romero motion argues the prior strike is remote, the current offense is out of character, and the defendant has demonstrated rehabilitation. Additional strategies include disputing whether a prior actually qualifies as a strike (some priors involve factual disputes about elements) and negotiating a plea to a non-strike alternative charge.
